1. Acceptance of Terms

By accessing or using LastingPath ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all visitors, users, and others who access the Service.

2. Description of Service

LastingPath is a document preparation and administrative guidance platform designed to help families and funeral professionals manage the paperwork required after a death. The Service includes:

  • A personalized checklist of applicable forms based on information you provide
  • Document preparation assistance using official government and institutional templates
  • Progress tracking and administrative guidance for estate settlement tasks
  • Integration tools for funeral homes to support families in their care

3. Not Legal, Tax, or Financial Advice

LastingPath is not a law firm. The information, checklists, documents, and guidance provided through the Service are for general informational and document preparation purposes only. They do not constitute legal, tax, financial, or professional advice.

Use of the Service does not create an attorney-client relationship, a CPA-client relationship, or any other professional advisory relationship.

Requirements for estate administration vary significantly by state, county, and individual circumstances. LastingPath may not capture every nuance applicable to your situation. For complex matters — including probate proceedings, contested estates, tax filings, and deed preparation in restricted states — you should consult a licensed attorney or other qualified professional.

4. User Responsibilities

By using the Service, you agree to:

  • Provide accurate and complete information to the best of your knowledge
  • Review all documents before signing or submitting them to any agency or institution
  • Ensure you have authority to act on behalf of the deceased's estate
  • Not use the Service for any unlawful purpose
  • Not submit false, fraudulent, or misleading information
  • Keep your account credentials secure

5. Accuracy of Information

LastingPath makes reasonable efforts to maintain accurate and current information about forms, deadlines, and procedures. However, laws, regulations, and government requirements change frequently. We do not guarantee that information is complete, current, or accurate for your specific jurisdiction or situation. You are responsible for verifying requirements with the relevant agencies, institutions, or professionals before taking action.

6. Intellectual Property

The LastingPath platform, including its design, software, content, and trademarks, is owned by LastingPath, Inc. and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our express written permission.

7. Limitation of Liability

To the fullest extent permitted by law, LastingPath and its officers, directors, employees, and agents shall not be liable for:

  • Any errors, omissions, or inaccuracies in forms, checklists, or guidance
  • Any delays, rejections, or losses resulting from your use of the Service
  • Any indirect, incidental, consequential, or punitive damages
  • Any loss of benefits, inheritance, or other estate assets resulting from errors in the process

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless LastingPath, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

9. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice. We may also update these Terms of Service from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which LastingPath, Inc. is incorporated, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with applicable rules.
